I'm a Business Owner

As a business owner you are responsible for the safe management and disposal of your business waste.

How you manage your waste could cost your business dearly in terms of money and reputation, if not disposed of correctly.

If you produce, carry, import, keep, treat or dispose of waste, you have a legal duty of care to make sure your waste is handled safely and only passed to people authorised to receive it.

If your waste is collected by anyone else, it is your responsibility to make sure they are a registered waste carrier and that they are taking your waste to a site authorised to accept it.

You also need to complete waste documentation (known as a transfer note) for every load of waste you pass to others.

You may be able to use a season ticket if you have regular collections of the same type of waste. Waste documentation should be kept for at least two years.

For hazardous waste the documentation should be kept for a minimum of six years.

You could be given an unlimited fine if you do not meet the duty of care towards your business waste.

The maximum penalties for fly tipping are £50,000 fine and up to 12 months imprisonment if convicted in Magistrates Court.  The offence can attract an unlimited fine and up to 5 years imprisonment if convicted in a Crown Court.

Producers of Hazardous Waste

If you produce or store over 500kg of hazardous waste per year, then you need to register your business with Natural Resource Wales every year.

You are also legally required to provide consignee returns to Natural Resources Wales every quarter which provides proof of the proper disposal of your hazardous waste.
